Third Party Functionality – Terms and Conditions
Introduction
Lovexa’s website and mobile applications provide a seamless experience by integrating various third-party services (such as payment gateways, map services, social media plugins, logistics tracking tools, etc.). These “third-party functionalities” are included for your convenience and to enhance the features available to you as a user. However, it’s important to understand that when you use these third-party services via Lovexa, additional terms and conditions may apply.
By using Lovexa’s platform, you acknowledge and agree to this: while we facilitate your interaction with these third parties, the ultimate control, responsibility, and legal terms for those services lie with the respective third-party providers, not Lovexa.
This section of our Terms and Conditions outlines the conditions and disclaimers related to third-party functionalities embedded or linked within Lovexa’s services.
Examples of Third-Party Services on Lovexa
To clarify, here are common third-party features you might encounter while using Lovexa:
- Payment Processing: When you make a payment for a purchase, we might redirect you to or embed a secure payment gateway (for example, Razorpay, PayPal, Stripe, a bank’s net-banking page, UPI interface, etc.). These are third-party payment processors that handle your transaction and payment data.
- Maps and Location Services: If our app/website shows maps (for store locations, order tracking, address autocomplete, etc.), it might be using services like Google Maps or Apple Maps. Entering addresses or using map interactions could be subject to Google’s/Apple’s terms of use and privacy policy.
- Login via Social Media or OAuth: If we offer “Login with Facebook/Google/Apple” or allow sharing content to social media, those are third-party authentication or sharing services. For instance, using “Login with Google” means you are also abiding by Google’s OAuth terms.
- Analytics or Personalization Tools: Though mostly behind the scenes, we might use third-party analytics, chatbot support, or product recommendation engines to improve your experience. While these don’t usually require user action, they are still external services integrated into our platform.
- Logistics and Shipping Updates: The tracking page for your shipment might actually display information from a courier’s tracking system or a third-party logistics API.
- External Links: Our platform might contain links to external websites or services (for example, a link to a manufacturer’s product demo video on YouTube or a link to our social media pages). Clicking those will take you outside Lovexa’s controlled environment into third-party territory.
Third-Party Terms of Use and Privacy Policies
Each third-party service integrated with Lovexa has its own Terms of Service/Use and Privacy Policy. We endeavor to inform you (usually via a disclaimer or in-line notice) when you are about to interact with a third-party feature, but even if not explicitly flagged, by using those features you agree that:
- You will abide by the terms of use of that third party. For example, if using a payment gateway, you agree to any user terms of that payment provider (which could cover things like acceptable use, prohibited transactions, etc.). If using map services, you agree not to misuse the map data as per the map provider’s terms. If logging in via a social account, you agree to that platform’s rules for account access.
- The privacy policy of the third party will govern the data handling for any information you provide through that functionality. For instance, payment details entered on a payment gateway page are primarily governed by the payment provider’s privacy policy (Lovexa doesn’t receive your full card details in such a scenario). Similarly, if you use Google’s address autocomplete, Google may collect some data per their privacy terms.
We encourage you to read the terms and privacy policies of these third-party services (which are usually linked at the point of interface, e.g., a “Terms” link on a payment page or a pop-up). While that can be a lot of information, awareness is key, especially when it involves your financial data or personal info.
No Endorsement or Control
Lovexa’s inclusion of third-party services is not an endorsement or guarantee of their quality, reliability, or legality. We select reputable partners and strive to ensure they work correctly, but:
- Independent Parties: Third-party providers are independent entities. Lovexa does not have control over their operations, content, or security. For example, if a bank’s net-banking system goes down or has a security breach, that is beyond Lovexa’s control.
- No Warranty by Lovexa: We do not warrant (promise) the functionality, availability, accuracy, or performance of third-party services. For instance, we cannot guarantee that the payment gateway will always accept your card or that Google Maps will always show the correct address pinpoint.
- Interface “As Is”: Any third-party feature on Lovexa is provided “as is” for convenience. You use it at your discretion. If you prefer not to use, say, a certain map or payment method, we often have alternatives (like manual address entry or different payment options).
Third-Party Failures or Errors
Given that third-party services might occasionally fail or produce errors (e.g., a payment doesn’t go through, a map doesn’t load, a login via Facebook isn’t working):
- No Liability for Service Failures: Lovexa is not liable for any losses or damages that arise from the failure of third-party services. For example, if a payment gateway outage causes your transaction to fail at the last step, or double-charges you, we will of course help resolve the issue (e.g., ensure you get a refund for a double charge) but we aren’t legally responsible for the gateway’s technical glitch or any bank fees, etc., that might result. Similarly, if a map misdirection causes a delivery delay, we’ll try to sort it out, but we aren’t liable for the map error itself.
- Dispute Resolution: If you encounter a problem solely attributable to a third party (like fraudulent activity on your card that you suspect happened on the gateway’s watch, or an OAuth provider’s account issue), you may need to follow up with that third party. Lovexa will assist to the extent possible (we can provide transaction references, platform logs, or direct contacts if we have them), but we can’t resolve issues inside another company’s system beyond our influence.
- Alternate Solutions: If one embedded service isn’t working, Lovexa will attempt to provide an alternate path. For instance, if a certain payment method is failing, we might suggest trying another method or a direct bank transfer outside the usual flow. If a social login fails, we’ll always have our own Lovexa login method as backup. This is to ensure you can still use Lovexa’s core services even if an auxiliary service falters.
Data Sharing and Consent
When you use a third-party functionality on Lovexa, some amount of data sharing is inherent:
- For example, if you choose to pay via credit card on a gateway, necessary purchase details (like your order amount, order ID, your name/email, etc.) will be securely passed to the payment processor to complete the transaction. Likewise, if you use a map to pick your address, the address you pick might be sent from Google Maps to us to fill in your form. If you login via a social provider, we might receive basic profile info from them (with your consent at login).
- By initiating these actions, you consent to this data exchange. Lovexa will only share the minimum required information with the third-party to perform the task (per our Privacy Policy). We also expect the third parties to use that data solely for the intended purpose (per their privacy commitments).
- We do not sell your personal data to third parties. Any sharing is purely functional (for service integration) or as described in our Privacy Policy (e.g., using analytics to improve our site).
- However, note that if you leave Lovexa’s platform via an external link, once you’re on a third-party site/app, the data they collect from you on their own site is subject to their practices. (For instance, if you click a link to an article on another site from our blog, that site might track you with cookies independent of Lovexa).
Third-Party Content and Accuracy
Some content you see on Lovexa might actually originate from third parties. Examples: product ratings aggregated via a third-party service, or a plugin that shows social media feeds. We try to vet such content, but:
- Lovexa is not responsible for the accuracy or completeness of information provided by third-party services. If a third-party tool shows, say, an exchange rate, a translation, or user reviews fetched from elsewhere, we present it “as received” for your convenience. Use your discretion, and double-check critical info from official sources if needed.
- If you see any content that is inappropriate or infringing and it’s coming through a third-party integration, please notify us. We will coordinate with the provider to address it (for example, if an embedded social feed shows an offensive comment, we might remove or mask that feed on our site and ask the social platform to handle it under their community guidelines).
Updates and Changes in Third-Party Services
Third-party providers can update their services, APIs, pricing, or terms over time:
- If a third-party service integrated with Lovexa changes or is discontinued, we will do our best to update our platform to reflect that. However, there might be times when a feature becomes temporarily or permanently unavailable because the third-party made a change beyond our control. We reserve the right to substitute or remove any third-party functionalities from Lovexa’s platform at any time. We will typically inform users if a significant feature is being removed or replaced (especially if it affects how you use our service).
- Your continued use of the platform after any integration changes signifies your acceptance of the new arrangement or any new third-party terms that might come with the change.
No Agency or Partnership
Using a third-party service through Lovexa does not create any legal partnership, agency, or joint venture between Lovexa and that third party or between you and that third party via Lovexa. Each party (Lovexa, user, third-party provider) is independent.
- For example, paying through Razorpay on Lovexa doesn’t mean Razorpay is an agent or partner of Lovexa in a way that would make us responsible for their actions beyond processing that transaction.
- Lovexa might have formal contracts with these providers, but those are separate commercial arrangements and typically invisible to the end-user. They do not alter your relationship with us beyond these terms, nor create any new relationship between you and the provider beyond their standard user relationship.
Intellectual Property of Third-Party Tools
The intellectual property (IP) rights of any third-party software or content used on our platform remain with the respective owners:
- For instance, the map imagery is likely copyrighted by Google or Apple; payment logos are trademarks of those companies; a chat widget might be proprietary to the vendor. You are granted a limited, non-exclusive right to use those as part of using Lovexa, but you obtain no ownership over them. You must not try to separate or copy those elements for your own use outside of Lovexa’s context.
- Any feedback or issues related specifically to third-party tech (like “the map interface is not user-friendly”) we can forward to them, but we can’t license or change their IP on our own.
Limitation of Liability and Indemnity
To reiterate and emphasize:
- Limitation of Liability: In no event will Lovexa be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of third-party services through our platform. Our total liability for direct damages, if any (not already disclaimed by other parts of our overall Terms of Service), will also exclude any damages attributable to third-party components.
- Indemnity: You agree to indemnify and hold harmless Lovexa from any claim or demand (including legal fees) arising out of your misuse of third-party services or your violation of third-party terms. For example, if you use the payment gateway for any unlawful activity or you scrape data from a third-party map violating their terms and they pursue action, you will bear responsibility, not Lovexa.
User Choices and Opt-Out
We aim to give you choices. If you do not agree to a third-party’s terms, you can choose not to use that feature:
- Alternative Payment: We usually have multiple payment options (if you don’t want to use a particular gateway, another might be available, or cod).
- Account Creation: If you prefer not to use social login, you can create a Lovexa account with email/password.
- Location Services: If you don’t want to use Google Maps, you can input your address manually and opt out of location-based features.
- Cookies/Tracking: Our Cookie Policy (related to third-party analytics or ads) will give options to opt out of non-essential cookies.
However, note that some core functionality might depend on third parties (e.g., we must use some payment processor for online payments). In such cases, if you decline those, the service may not be usable (e.g., you’d have to refrain from online purchases if you don’t want any online payment).
Contact and Dispute Handling
If you have issues arising from a third-party service on Lovexa, you can reach out to us at [email protected]. We’ll help liaise with the third-party if needed and do our best to resolve it.
- For example, if your payment is stuck, we can contact the payment provider on your behalf.
- If a third-party provider is unreachable or unresponsive, we will escalate through our channels (we often have account managers or support lines with them).
- Any formal legal dispute or claim related to third-party services would likely involve that third party directly. Lovexa’s own Terms (including arbitration or jurisdiction clauses) might not apply to the third party, so legal avenues could differ. But initially, come to us, and we’ll guide next steps.
Conclusion
In summary, we want you to enjoy the rich functionality on Lovexa with full awareness that not every piece is built or controlled by us. We curate these services for a better user experience, but with that convenience comes the need to acknowledge their independent terms. By using Lovexa, you accept these Third-Party Functionality T&Cs as part of our overall Terms of Service.
Thank you for understanding, and as always, we value your trust. We will continue to work with reliable partners and keep our integrations smooth and secure.
